Jim
is a 1986 graduate of the College of William and Mary, where he was
elected to Beta Gamma Sigma, the national business honor society. He
is a 1989 graduate of the University of Virginia School of Law.
Prior to being a founding member of Wall Esleeck Babcock, Jim
practiced as a partner with Kilpatrick Stockton in its corporate and
health care departments. Prior to his experience with Kilpatrick
Stockton, Jim was a shareholder and director of Bell, Davis & Pitt,
P.A., where he practiced in the firm’s corporate, health care, and
insolvency sections.
In addition to his health care and corporate experience, Jim has
experience in bankruptcy and insolvency matters, having served on
the North Carolina Bar Association Bankruptcy Council from
1995-1997. He is also a member of the American Health Lawyers
Association (Physician Organization, Fraud and Abuse and Long Term
Care Practice Groups)
Jim is a frequent speaker and author
on issues affecting health care and small businesses. He advises
health care clients on Stark, Anti-kickback, and HIPAA compliance,
as well as other regulatory matters affecting health care providers
and those providing management and other services to providers. He
assists clients with choice of entity and compliance issues, and
well as director responsibilities and fiduciary duties. He
represents municipal corporations and quasi-governmental agencies
with respect to corporate issues as well as open meetings and public
records issues. He has vast experience in counseling corporate
clients in significant contractual relationships, including
executive employment (compensation, non-compete and confidentiality
issues), independent contractors, and vendors.
Jim
is a certified mediator, has been recognized as a Legal Elite by
Business North Carolina magazine, and is included in the 2008
edition of The Best Lawyers in America. Jim holds an AV rating from
Martindale-Hubbell.
Jim
is an active volunteer for the YMCA and other organizations for whom
he has coached numerous youth teams. He has also served as a junior
varsity football coach at a local high school, and is the founder of
Spring Hoops, an after-season basketball clinic for youngsters.
